DAEMEZ SOLUCIONS, S.L. (hereinafter, “DAEMEZ”) is committed to protecting the privacy of users who access https://daemez.com (hereinafter, the “Website”).

This Policy explains what personal data we process, for what purpose, on what legal basis, for how long we retain it, with whom we share it and what rights you have.

It applies solely to this Website. It does not apply to third-party websites linked from here, whose policies you should review separately.

2. Data we process

You may browse the Website without providing any identifying personal data.

The personal data we process through this channel is what you voluntarily provide through the available channels, together with the technical connection data recorded automatically, as described below.

3. Processing activities

3.1. Enquiries by email or telephone

Purpose To respond to your enquiry, information request or quotation request.
Data processed Whatever you voluntarily include in your communication: name, company, email address, telephone number and message content.
Legal basis Art. 6(1)(b) GDPR — pre-contractual steps. Alternatively, art. 6(1)(a) GDPR — your consent.
Retention period Twelve (12) months from the last communication, unless a contractual relationship arises.

3.2. Web analytics

Purpose To understand how the Website is used, produce aggregate statistics and improve its content and performance.
Data processed IP address (truncated or anonymised where applicable), device or cookie identifier, pages visited, visit duration, traffic source, browser type and operating system.
Legal basis Art. 6(1)(a) GDPR — your consent, given through the cookie preferences panel.
Provider Matomo (self-hosted by DAEMEZ)
Retention period As set out in the Cookie Policy.

Analytics cookies are not installed until you accept them.

When you reach the Website through a link included in an email campaign, the URL may carry a campaign identifier and, where applicable, an identifier of the mailing you received, allowing your visit — and your subsequent visits — to be linked to that campaign. This processing takes place only if you accept analytics cookies and is governed by the same legal basis and retention periods stated in this section.

You may change or withdraw your choice at any time from the cookie preferences panel.

3.3. Website security and technical logs

Purpose To ensure the security and integrity of the Website, prevent fraudulent or abusive use and diagnose technical incidents.
Data processed IP address, timestamp, requested resource, response code and user agent, recorded by our hosting provider.
Legal basis Art. 6(1)(f) GDPR — legitimate interest in protecting our information systems and the data they contain.
Retention period Twelve (12) months, unless a longer period is required to investigate a security incident.

3.4. Management of the commercial and contractual relationship

Purpose To manage the pre-contractual and contractual relationship, provide the contracted services, invoice and comply with the associated legal obligations.
Legal basis Art. 6(1)(b) GDPR — performance of a contract. Art. 6(1)(c) GDPR — tax, accounting and commercial legal obligations.
Retention period For the duration of the relationship and thereafter for the statutory limitation periods.

4. Source of the data

The personal data we process is obtained directly from you. We do not obtain personal data from third-party sources or publicly accessible sources for the purposes described in this Policy.

5. Automated decision-making and profiling

DAEMEZ does not carry out automated decision-making producing legal effects concerning you or similarly significantly affecting you, nor profiling within the meaning of art. 22 GDPR.

6. Recipients of the data

Your data may be disclosed to:

  • Service providers acting as processors on behalf of DAEMEZ, with whom the corresponding agreement under art. 28 GDPR has been signed. In particular, Hetzner Online GmbH as hosting and infrastructure provider.
  • Public authorities, courts and tribunals, where there is a legal obligation to do so.
  • Financial institutions and professional advisers, where necessary for the management of collections, payments and tax and accounting obligations.

No disclosures other than those indicated are made, and personal data is neither sold nor transferred to third parties for advertising purposes.

7. International data transfers

As a general rule, your data is processed on servers located within the European Economic Area (EEA).

Where a provider involves an international transfer outside the EEA, DAEMEZ ensures it relies on one of the mechanisms in Chapter V of the GDPR: a European Commission adequacy decision — including the provider’s certification under the EU-U.S. Data Privacy Framework for transfers to the United States — or Standard Contractual Clauses, supplemented where necessary by additional measures following a transfer impact assessment.

8. Your rights

You may exercise, at any time and free of charge, the rights of access, rectification, erasure, restriction of processing, portability and objection, and withdraw consent given, without affecting the lawfulness of prior processing.

How to exercise them: by sending a request to oscar@daemez.com or by post to Calle Mont Blanc, 10, puerta 7, 08195 Sant Cugat del Vallès (Barcelona), indicating the right you wish to exercise. We may request additional information to verify your identity where there are reasonable doubts as to it.

We will respond within one month of receipt, extendable by a further two months depending on complexity and the number of requests, in which case we will inform you of the extension.

Exercising these rights is free of charge, except for manifestly unfounded or excessive requests, particularly repetitive ones, in which case we may charge a reasonable fee or refuse to act.

Complaint: if you consider that the processing does not comply with the applicable legislation, or that we have not properly handled your request, you may lodge a complaint with the Spanish Data Protection Agency (C/ Jorge Juan, 6, 28001 Madrid — www.aepd.es).

9. Minors

The Website is not directed at children under fourteen (14) years of age and we do not knowingly collect data from children below that age.

Pursuant to art. 7 of Spanish Organic Law 3/2018 (LOPDGDD), processing data of children under fourteen requires the consent of the holders of parental responsibility or guardianship.

If we become aware that we have collected data from a child under fourteen without such authorisation, we will delete it. If you become aware of such a situation, notify us at oscar@daemez.com.

10. Security measures

DAEMEZ has implemented appropriate technical and organisational measures to ensure a level of security appropriate to the risk, in accordance with art. 32 GDPR, including:

  • Encryption of communications using the TLS protocol.
  • Access control based on unique identifiers, strong authentication and least privilege.
  • Regular backups and tested restoration procedures.
  • Activity logging and system monitoring.
  • A documented personal data breach management procedure, including notification under arts. 33 and 34 GDPR.
  • Confidentiality undertakings signed by personnel with access to personal data.

No security measure guarantees absolute protection. DAEMEZ reviews their effectiveness periodically.

11. Confidentiality

DAEMEZ and its personnel undertake to comply with the duty of secrecy in respect of the personal data to which they have access, an obligation that survives the termination of the relationship.

13. Changes to this Policy

DAEMEZ may update this Policy to reflect legislative changes, new processing activities or modifications to the Website. The version in force will always be the one published on this page, indicating the date of last update. Where changes are substantial, we will notify you by appropriate means.
